Negligence, Gross Negligence, and Malpractice
The unintentional tort of negligence is the basis for professional malpractice claims (Judson & type Aere; Harrison, 2010, p. 101). This occurs when health help providers depart from acceptable medical exam practice resulting in disparage to the patient (Judson & Harrison, 2010). This paper provide differentiate negligence, gross negligence, and malpractice, and evaluate the nurses medical and legal responsibilities.
Negligence
Negligence occurs when someone inadvertently executes or fails to perform an act that a reasonable person would or would non have done is similar circumstances, not intended to induct harm but committed unreasonable or with a disregard for the consequences (Judson & Harrison, 2010, p. 69). Judson and Harrison add that there are quaternary elements or the four Ds of negligence: duty, dereliction, direct cause, and reparation (Judson & Harrison, 2010, p. 101).
The person charge with negligence has an obligation to care for the accuser and has violated that obligation; as a result, the accuser sustained injuries requiring reparations (Judson & Harrison, 2010).
Gross Negligence
According to the second edition of the Wests Encyclopedia of American Law, gross negligence is a conscious and voluntary disregard of the need to use reasonable care, which is plausibly to cause foreseeable grave injury or harm to persons (The Gale Group, 2008).
